ASC complaint by ASCfighter
I am also a customer (not a lawyer) of America's Servicing Center (aka ASC) and have been reading on numerous message boards about the same situations over and over with customers of ASC. Such as Incorrect information given, misplaced payments, false information, lies and downright fraud.

Many other posters have mentioned an interest in a class action suit, so if you are a client of ASC and are having problems with them please email me (just once) about your situation and what ASC has done or failed to do. Please include the following information: First Initial and Last Name, City & State, When you got the loan with ASC or when they bought it, If you are behind in your payments how many months. And then your story. DO NOT SEND ME ANY PERSONAL INFORMATION such as account numbers or ss#!!!

I figure if I can get enough people together I can then (hopefully) find a lawyer to help with a class action suit. I am not guaranteeing anything and I personally cannot provide any type of assistance. I am not a lawyer, I am just in the same situation as many other people. We must come together to fight this company!!!

I am TOTALLY interested in joining a calss action suit!!!!!! These people went to court on my home- entered judgement (1 day after receiving nearly 2500 in payment- for an arm reset modification!!!!????) i was not notified of this court date- was paying as these crooks had set up for me too- THEN after I think things are back on track- had a flood issue ($10,000 worth or property damage) sent the insurance check to theese people to endorse- GUESS what- they are holding it due to the "status" of my loan (last payment of their repayment plan-needed because of their screw-up- was made the day after they recieved my check!!!). so i now have a home i intend on staying in w/my family- that has standing water (more coming in daily- more damages daily) because they refuse to send me back the check made out to both of us!!!!!!!!! from state farm to fix theproblem & repair my finished basement!!!!i will go wherever & provide them w/whatever JUST to stop these CROOKS!!!!!!!!!!!!!!

:( Asc what a joke ...I've had the misfortune of having to deal w/them ..My original mrtge co . sold my mortgade to ASC 2 yrs ago that's when all the problems started I never recieved a statement so I sent my payment to my original mrtg co then recieved it back sent it to ASC received it back again but as a ASC business chk called them to ask why they sent it back and the said because it was late...then ASC would no longer speak w/me I received a letter from an attorney stating I owe them 3 thousand dollars

because ASC hired them to begin foreclosure proceedings, I called a company named House 911 in which I payed them 1,500.00 to get my mtge straightened out do you know it took 10 months now I am 32,000 behind and that was put on the end of my thirty yr term so now i need to give ASC 2,613.00 in three bulk pymts and I should have received a package with this agreement 2 months ago & nothing as of yet they keep saying they have sent it out .....what a joke .I am afraid I will cme hme one day & my house will be locked up.

I am very interested. I have filed Chapter 13 to keep from losing my house to ASC. They never filed a claim

to the bankruptcy court. This has been over a year ago. Two weeks ago, I receive a letter from bankruptcy, ASC is raising my rent from 525 to 696.89 a month. In the mean time I have been paying payments to Chapter 13 for ASC, that has never been payed to ASC , because they haven't filed a

claim. Yet they raised my rent almost 200 dollars!!! When I called ASC, they still have my house in foreclosure! What a bunch of jerks!!

The only reason they raised my rent is so they can have my house. They think I will move out. I am not in a position to just go out and buy another house. And since I am in bankruptcy, I don't know if I could even try to refinance or sell this house. If you get something going against ASC, I am very interested.

I will drive everyone to any lawyer to get a suit started. They are horrid! You never get anyone who has a clue about loans, everyone there makes $9/hour and has the power to toss you out of your house. I know they are breaking the law- i am not a lawyer and can't prove it......

I have java, but I see no address??? ASC is telling me that I have insufficient wind insurance and that they're tacking on their own insurance policy at the tune of $1800 per year. My agent has faxed the policy info numerous times with no response. We seem to think this is a scam to extort $$ from hapless homeowners. He is reporting it to the state insurer's board. If there is a CA lawsuit, count me in. But I still see no email address. I'm CL1234BK at that yay-hoo place.

VERY INTERESTED!! We lost our buyer during a short-sale (now losing our home in foreclosure to ASC) because they're holding 20K of our insurance money "on account" and not paying the contractor. The buyers backed out because it was taking too long. Now we have no choice but to lose our home and our credit....We did qualify for loan modification based on the pre-determined standards at one time, too, but they turned us down three times - after taking three months to review our paperwork. To date, the contractor still hasn't been paid and it's been 9 months so far. Also, our trustee sale date has been post-poned over 6 times - maybe 10 times now, and we've never been sent any letters; CA law requires a whole new Foreclosure proceeding to start after three post-ponements. We should have started over three times now....and our contractors haven't even been paid! S & J Sauce, Cloverdale, CA - behind 18 months due to 3 catastrophic losses (a large tree fell through our roof - twice, and then the rain started...). Our loan started on 08/06, and then our 1st tree fell 05/07. Our foreclosures have been every 2 weeks since 07/12/07....sometimes every 30 days. They just keep postponing them due to the insurance claims, but keep sending us bills, but won't pay the contractors. Now the contractors have leins on the house and we actually had a buyer for 5 months to save us in a short-sale!

I recieved my loan in 2005. My last payment on my loan was in January of 2008. Losing home to foreclosure. Bought the home for 398,000 and it is now worth 170,000. What a nightmare! If you do get something going, please let me know. Thank you.
